REGULATIONS OF THE "sklep.automatyczni.com" internet shop

Effective from: 26.06.2025 r.

These Terms and Conditions set out the terms and conditions for the provision of electronic services, including the use of the Online Shop, and the conclusion of distance sales contracts between the Customers and the Seller.

§ 1 Definitions

The terms used in these Regulations shall mean:

  1. Seller - Automatyczni GM sp. z o.o. with registered office in Lisich Kąty 8, 86-302 Grudziądz, Poland, entered in the Register of Entrepreneurs of the National Court Register under KRS number: 0001027993, holding NIP: 8762504186 and REGON: 524861890.
  2. Shop - the website operated by the Seller under the following domain addresses https://automatyczni.com and https://automatyczni.sklep.plthrough which Customers can conclude Sales Agreements.
  3. Customer - a natural person with full legal capacity, a legal person or an organisational unit without legal personality, to which legal capacity is granted by law, using the Shop.
  4. Consumer - A customer who is a natural person making a legal transaction with the Seller which is not directly related to his/her economic or professional activity.
  5. Trader with consumer rights - A customer who is a natural person who enters into a contract directly related to his/her business activity, where it is apparent from the content of the contract that it is not of a professional nature for that person, arising in particular from the subject matter of his/her business activity (based on PKD codes).
  6. Entrepreneur - Customer who is neither a Consumer nor an Entrepreneur on the rights of a Consumer.
  7. Regulations - this document.
  8. Sales Contract - the contract of sale of the Goods or Digital Product concluded at a distance between the Customer and the Seller through the Shop.
  9. Merchandise - a movable item offered by the Seller in the Shop.
  10. Digital Product - the digital content or service (e.g. software, access to a platform) offered in the Shop.
  11. Customer Account (Account) - free of charge electronic service, a set of resources in the Seller's ICT system, marked with an individual e-mail address and a password, in which the Customer's data is collected, including information about orders placed.
  12. Basket - a functionality of the Store that allows the Customer to aggregate selected products before placing an order.
  13. Working Day - one day from Monday to Friday, excluding public holidays in Poland.
  14. DSA - Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on the digital single market for services (Digital Services Act).
  15. RODO - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data.

§ 2 Seller information and contact (Impressum)

§ 3 General provisions and technical requirements

  1. The Terms and Conditions are addressed to all Customers of the Store. Acceptance of the Terms and Conditions is voluntary but necessary to set up an Account or place an order.
  2. To use the Shop it is necessary to:
    • A terminal device with access to the Internet.
    • Current browser version with cookies and JavaScript enabled.
    • An active electronic mail (e-mail) account.
  3. The Seller is not responsible for any disruptions in the functioning of the Shop caused by force majeure, unauthorised actions of third parties or incompatibility of the Shop with the Customer's technical infrastructure.

§ 4 Electronic Services in the Shop (Customer Account, Newsletter)

  1. The Seller provides the following electronic services free of charge: Customer Account and Newsletter.
  2. Customer account: Registration is voluntary. It allows you to track the status of your orders, view your purchase history and place further orders more quickly. The Account Agreement is concluded for an indefinite period upon completion of registration.
  3. Newsletter: Service to send commercial and marketing information. Subscription is voluntary and requires consent. The contract for the Newsletter service is concluded for an indefinite period of time.
  4. The Customer may cancel the Account or the Newsletter at any time, without giving any reason and without incurring any costs, by sending an appropriate request to the e-mail address of the Seller or by using the cancellation link in the Newsletter messages.
  5. A customer who is a Consumer or an Entrepreneur with consumer rights has the right to withdraw from a contract for the provision of electronic services within 14 days of its conclusion.

§ 5 Ordering Principles

  1. The product information in the Shop constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  2. The customer places an order by adding the products to the Basket and then completing the order form, providing the data necessary for its fulfilment.
  3. At the ordering stage, the customer chooses the delivery method and the payment method.
  4. The order is placed by clicking on a button that explicitly confirms the obligation to pay, e.g. "I buy and pay". By clicking on this button, the customer makes a binding offer to purchase.
  5. The customer is obliged to provide true and complete data. The seller is not responsible for the consequences of incorrect data (e.g. delay or non-delivery).

§ 6 Conclusion of the Sales Contract

  1. The Sales Contract is concluded as soon as the Seller sends a confirmation of acceptance of the order for processing to the Customer's e-mail address.
  2. If it is not possible to fulfil part or all of the order (e.g. due to lack of goods), the Seller will inform the Customer immediately. The Customer may then cancel the entire order, give up the missing product or agree to an extended lead time.
  3. If the Customer has paid for an order that cannot be fulfilled, the Seller will immediately refund the funds paid.

§ 7 Prices and Payment Methods

  1. All prices given in the Shop are gross prices (including VAT) and expressed in Polish zloty (PLN). Prices do not include delivery costs.
  2. The total value of the order, including the price of the products and delivery costs, is visible in the Basket before the order is placed.
  3. Payment methods available:
    • Quick online payments (Przelewy24, AutoPay, BLIK, credit cards).
    • Payment on delivery (upon receipt of the consignment).
    • Traditional bank transfer (if the option is available).
  4. Payment operators are third-party providers. Transactions take place in accordance with the regulations of these entities.
  5. The seller attaches a proof of purchase (receipt or VAT invoice) to each order.

§ 8 Delivery of Goods and Digital Products

  1. Delivery of Goods is limited to the territory of the Republic of Poland and countries of the European Union. Shipment to other countries requires individual arrangements.
  2. The available delivery methods and costs are indicated each time during the ordering process.
  3. The dispatch date of the order is specified on the product card or in the order summary. Normally, it is up to 3 working days from the day the contract is concluded (or payment is credited in the case of prepayment).
  4. Delivery of the Digital Products is made by sending a download link or access data to the Customer's e-mail address.
  5. The customer should check the condition of the parcel in the presence of the courier. If damage is found, it is recommended to draw up a damage protocol, which will make the complaint process much easier.

§ 9 Statutory right of withdrawal

  1. The Customer who is a Consumer or an Entrepreneur on consumer rights has the right to withdraw from the Sales Contract without giving any reason within 14 days. The Seller voluntarily extends this period to 15 days.
  2. The time limit for withdrawal shall run:
    • for a contract of sale of Goods, from the taking possession of the Goods by the Customer or a third party other than the carrier designated by the Customer;
    • for a contract for the supply of a Digital Product, from the date of conclusion of the contract.
  3. In order to exercise the right of withdrawal, the Customer must inform the Seller of his/her decision by an unequivocal statement (e.g. a letter sent by post or e-mail). The Customer may use the model withdrawal form for this purpose, but this is not obligatory.
  4. In the event of withdrawal from the contract, the Seller shall reimburse to the Customer all payments received, including the costs of delivering the Goods (with the exception of additional costs resulting from the method of delivery chosen by the Customer other than the cheapest ordinary method offered by the Seller), immediately and in any case not later than 14 days from the day on which the Seller was informed of the decision to exercise the right of withdrawal.
  5. The payment will be refunded using the same means of payment used in the original transaction, unless the Customer has expressly agreed otherwise.
  6. The seller may withhold reimbursement until it has received the Goods or until it has provided proof of return.
  7. The Customer is obliged to return the Goods to the Seller immediately, but no later than 14 days from the date of withdrawal from the contract. The cost of directly returning the Goods shall be borne by the Seller - for this purpose, use the return form provided by the Seller to generate a shipping label.
  8. The customer shall be liable for any diminution in the value of the Goods resulting from the use of the Goods beyond what is necessary to ascertain their nature, characteristics and functioning.
  9. The right of withdrawal does not apply to contracts as defined in Article 38 of the Consumer Rights Act, inter alia, for the supply of digital content not supplied on a tangible medium, if the performance has begun with the express consent of the Customer before the expiry of the deadline for withdrawal.

§ 10 Compliance with the Contract and Complaints Procedure

  1. Provisions for Consumers and Entrepreneurs on Consumer Rights:
    • The Seller shall be liable for any non-conformity of the Goods or Digital Product with the contract, existing at the time of delivery and discovered within two years of that time.
    • In the event of non-conformity with the contract, the Customer is entitled to request repair or replacement. The Seller may make a replacement when the Customer requests a repair, or vice versa, if bringing the product into conformity with the contract in the manner chosen by the Customer is impossible or would require excessive costs.
    • If repair and replacement are impossible or would require excessive costs, the customer may make a declaration to reduce the price or withdraw from the contract.
  2. Provisions for Entrepreneurs:
    • With regard to Customers who are Entrepreneurs, the Seller's liability under warranty for physical and legal defects of the Goods on the basis of Article 558 § 1 of the Civil Code is excluded.
  3. Making complaints:
    • Complaints can be submitted in writing to the Seller's address or electronically to the e-mail address: [email protected].
    • The application should contain your name, address, proof of purchase, a description of the defect and the claim.
    • The seller will consider the complaint within 14 days of receipt.

§ 11. Product and User Content Feedback (DSA Rules)

  1. The Seller allows Customers to post opinions about products. The Seller verifies that the reviews come from Customers who have actually purchased the product in question.
  2. The posting of unlawful, vulgar, offensive, misleading content, content which infringes the personal rights or copyrights of third parties or content which constitutes unsolicited commercial information (spam) is prohibited.
  3. The Vendor, upon receipt of a report of unlawful content, will take action in accordance with the "notice and action" procedure provided for in the DSA, including may remove or block access to such content.
  4. The submitter as well as the author of the content will be informed of the decision and the remedies available to them.

§ 12 Protection of personal data

  1. The administrator of the customers' personal data is the Seller.
  2. Personal data is processed for the purposes related to the performance of the Sales Agreement, the provision of electronic services and for other purposes set out in the Privacy Policy.
  3. For detailed information on the processing of personal data, including the Customer's rights, please refer to the "Privacy and Cookie Policy" available in the Shop.

§ Section 13 Intellectual Property

All content in the Shop, including names, trademarks, logos, images and descriptions, are the intellectual property of the Seller or its affiliates and are protected by law. Their use without prior written consent is prohibited.

§ 14 Extrajudicial Dispute Resolution (ODR)

  1. The consumer has the option of using out-of-court complaint and redress procedures.
  2. Detailed information on the consumer's possibilities of using out-of-court complaint and redress procedures, as well as the rules of access to these procedures, are available at the offices and websites of district (city) consumer ombudsmen, social organisations whose statutory tasks include consumer protection, Provincial Commercial Inspection Inspectorates.
  3. At http://ec.europa.eu/consumers/odr a platform for online dispute resolution between consumers and traders at EU level (ODR platform) is available.

§ 15 Final provisions

  1. Applicable law: Polish law shall apply to contracts concluded through the Shop. However, the choice of Polish law shall not deprive the Consumer of the protection afforded to him under provisions that cannot be derogated from by contract under the law of the country in which the Consumer has his habitual residence.
  2. Contract language: Contracts are concluded in Polish.
  3. Court of jurisdiction: Any disputes arising between the Seller and a Customer who is a Consumer or an Entrepreneur on consumer rights will be settled by the competent courts in accordance with the provisions of the Code of Civil Procedure. In the case of disputes with a Customer who is an Entrepreneur, the competent court is the court with jurisdiction over the registered office of the Seller.
  4. Changes to the Rules of Procedure: The Seller reserves the right to make changes to the Terms and Conditions for important reasons (e.g. change of laws, change of payment and delivery methods). The changes will not affect the acquired rights of Customers. Customers with an Account shall be informed of each change by e-mail. The new version of the Terms and Conditions shall be effective as of the date of its publication in the Store.
  5. Matters not covered by these Rules shall be governed by generally applicable provisions of Polish law.
